Refund Policy

1. Introduction

This Refund Policy outlines the terms under which Creative Emm LLC (“Creative Emm,” “we,” “us,” “our”) processes refunds for digital creative services, including branding, design, website development, UI/UX, and related digital deliverables.

As a service-based digital agency, all items delivered by Creative Emm LLC are non-tangible, irrevocable digital goods. Therefore, this policy is structured in accordance with:

  • Wyoming Consumer Protection Act
  • U.S. Federal Trade Commission (FTC) guidelines on service-based transactions
  • Best practices for digital service providers
  • International e‑commerce service standards
  • Our Operating Agreement governing service delivery

2. Nature of Our Services (Non‑Refundable by Default)

Because Creative Emm LLC delivers custom, labor-intensive digital work—including branding, design concepts, visual assets, website layouts, and creative strategy—all sales are final.

This includes:

  • Logo and brand identity design
  • Website design or development
  • UI/UX wireframes, prototypes, or interfaces
  • Marketing design assets
  • Pitch decks and presentations
  • Digital content creation
  • Subscription-based design services

Once work has begun or any initial draft has been delivered, refunds cannot be issued.


3. Refund Eligibility (Limited Cases)

A refund may be considered only under the following exceptional conditions:

3.1 Duplicate Payment

If a client is mistakenly charged twice for the same service.

3.2 Payment Processing Error

If our payment processor (Stripe/PayPal/Wise/etc.) confirms an incorrect or failed transaction.

3.3 Work Not Initiated

If Creative Emm LLC has not yet started the project AND no resources have been allocated. Once scheduling, research, or design initiation begins, the project becomes non-refundable.

3.4 Service Unavailable

If Creative Emm LLC is unable to deliver the service due to internal issues (extremely rare; requires documentation).

Refund decisions under these criteria are made at Creative Emm LLC’s sole discretion.


4. Non‑Refundable Situations

Refunds will not be issued in the following circumstances:

  • Change of mind after project start
  • Client delays or lack of communication
  • Differences in subjective design preferences
  • Cancellation after work has been delivered or drafts shared
  • Failure to use or implement delivered services
  • Inability to secure internal approvals on client’s side
  • Third-party delays affecting timelines (hosting, domains, platforms)

5. Revisions & Satisfaction

To ensure client satisfaction, Creative Emm LLC provides:

  • Clear revision cycles (as stated in proposals or plans)
  • Transparent communication throughout the project
  • Quality control and design consistency aligned with Creative Emm guidelines

However, revisions do not constitute grounds for refunds.


6. Service Subscription / Retainer Plans

For monthly or recurring design subscriptions:

  • Payments are non-refundable once the billing cycle begins
  • Cancellation applies to the next billing cycle only
  • Purchased time or requests cannot roll over

7. Chargebacks & Dispute Policy

Initiating an unjustified chargeback is considered a breach of contract.

Creative Emm LLC reserves the right to:

  • Provide evidence to dispute the chargeback
  • Suspend ongoing services
  • Terminate client relationships

We follow FTC and card network rules when responding to disputes.


8. Delivery of Services

All services are delivered digitally through:

  • Email
  • Project management tools (Notion, Trello, ClickUp, etc.)
  • Cloud storage links
  • Design platforms (Figma, Adobe Cloud)

Once delivered, services are deemed consumed.


9. Requesting a Refund

If you believe you qualify for a refund based on the criteria listed above, please submit a written request to:

  • Full name
  • Email used during purchase
  • Service purchased
  • Transaction ID
  • Reason for refund request
  • Supporting documents (if applicable)

Refund reviews take 5–10 business days.


10. Policy Updates

Creative Emm LLC may update this policy to reflect changes in:

  • U.S. law or Wyoming regulations
  • Industry standards
  • Business operations

Updated versions will display a new “Effective Date.”
